Amidst the questions surrounding the election campaign, Arvind Kejriwal may walk out of jail. Meanwhile, the Enforcement Directorate (ED) not only opposed interim bail but also prepared a complete plan to corner Kejriwal and his Aam Aadmi Party by submitting a supplementary charge sheet.

The ED is portraying Kejriwal as the main character in the liquor scam. Additionally, today the ED may file a supplementary charge sheet against Arvind Kejriwal, implicating the AAP as well. Meanwhile, another crucial hearing took place today in the Delhi liquor scam. The High Court has issued a notice to the Enforcement Directorate (ED), seeking a response within two weeks in the bail matter of Ms. Kavita.

The bail application of Kavita was previously dismissed by the lower special court. Upholding the same order, Justice Swarnakanta Sharma of the High Court refused to grant bail to Kavita, acknowledging the arguments presented by the ED. Now, Kavita will challenge the High Court’s order in the Supreme Court.

The Aam Aadmi Party has asserted that the arrest of CM Arvind Kejriwal was based on statements from four approved witnesses of the ED – Magunta Reddy, Sarath Reddy, Satya Vijay Naik, and a former BJP CM’s close associate, all directly associated with the BJP. AAP stated that just five days after the Model Code of Conduct came into effect, the ED unlawfully ‘picked up’ a current CM and a national coordinator of a national party, thereby giving BJP an unfair advantage in the ongoing elections.

Saurabh Bharadwaj stated, “I have been listening to the Supreme Court debate for two to three days now. The central government is arguing in court that interim bail cannot be granted for elections. If you grant bail to them, you’ll have to grant it to others too. Dilip Ray, who was a coal minister in the Vajpayee government, was sentenced. But a person sentenced can contest elections…On the other hand, no allegations have been proven against Arvind Kejriwal, yet the central government is opposing his bail. On April 9, the High Court upheld Kejriwal’s arrest as valid, stating that after repeatedly refusing to attend summons and participate in Kejriwal’s investigation, the ED had ‘very limited options’ left. This case is related to alleged corruption and money laundering in the formulation and implementation of the Delhi government’s excise policy for 2021-22, which has now been terminated.

Rajya Sabha MP and senior advocate of the Supreme Court, Kapil Sibal, said, “Yesterday, the ED presented its side in front of the Supreme Court, stating that interim bail should not be granted to Arvind Kejriwal because the right to campaign is a legal right, not a constitutional right…

This is correct. But the law also provides that if someone has been sentenced and the court says they are inhibiting the sentence, they can still participate in election campaigning…Ask them how Hardik Patel contested the elections? He was declared guilty, the High Court had stopped him. Hardik knocked on the door of the Supreme Court, and the court put a stop to it.

Hardik contested elections and joined the BJP, against whom you have evidence and punishment, if the court puts a stop to it, then he has the right (to campaign). But someone who is merely accused cannot be stopped…What kind of politics is the ED playing?…”

Arvind Kejriwal Arrested on March 21
Arvind Kejriwal, the national convener of the Aam Aadmi Party (AAP), was arrested on March 21 and is currently in judicial custody in Tihar Jail. Justice Deepankar Datta was also involved in this. The bench had reserved its verdict on Kejriwal’s interim bail plea for May 7.

ED Opposing Bail

The Enforcement Directorate (ED) has filed a reply in the Supreme Court opposing Kejriwal’s interim bail plea through an affidavit on Thursday, stating that no leader has been granted interim bail for election campaigning, even if they are not contesting elections.
